Thank you for using our services (coovy.io / the Coovy platform / the Coovy mobile app and website). Our goal is to offer you the best possible experience at all times. If you ever have a bad experience with our service, please contact us immediately.

Our mission is to optimize marketing processes between businesses and influencers so that more efficient campaign management is possible for both parties. To ensure this, we need to collect, use and share some of your personal information. This privacy policy (or “data privacy declaration”) is designed to help you understand how we do this and how you can exercise the rights that you have over your information.

We are committed to protecting and respecting your personal information at all times and to provide you with opportunities to access and delete this information.

Overview:

I. Scope of our policy

This policy covers all Coovy users worldwide, as well as all technical means of the Coovy services, including our apps, websites, functions and other services (collectively also referred to as “Coovy”, the “platform”, or “Coovy platform”).

Our approach to collecting, processing and storing information is always subject to the applicable laws in the regions in which we operate. In addition to your use of the Coovy platform, our Terms & Conditions apply, which you should read before using our platform. You can find them here.

 

This privacy policy applies in particular to:

  • Companies and business people, or their employees using the platform for creating campaigns and marketing tasks and to find service partners, or collaborators for the implementation of the campaigns (“influencers”)
  • Influencers and those who would like to become active in online marketing (influencer marketing / social media marketing) and use the platform to find and collaborate in campaigns

 

In order to simplify this data protection declaration, the various users of our platform to whom this data privacy declaration applies are sometimes referred to collectively as “users”.

If you use the Coovy platform, we collect, process and store the information you provide about the use of our services, as well as information about the devices you use to access our platform. If possible, we also collect information about you from other sources, such as third party services. We can combine this information with other information we have about you. This privacy policy regulates the collection of personal data by the Coovy platform. We can only collect data from you about the usage of our platform if you start using our platform. If you do not agree to one or more declarations of this privacy policy, or our terms and conditions, or do not fully understand them, please contact us or simply not use the Coovy platform.

II. Responsible entity

Coovy Deutschland UG (haftungsbeschränkt), c/o Factory Berlin, Rheinsberger Str. 76/77, 10115 Berlin, Germany, is responsible for the collection, processing and storage of your personal data in connection with the use of the Coovy platform.

The personal data we collect can be stored and processed within and outside of the EU. For this we generally use the services of third parties, which are generally known, permitted and suitable to process such data in order to be able to transmit the data in accordance with applicable law. These include the services of Google Cloud Services (Google Inc., Google LLC, or Alphabet Inc.), Stripe Payment Services (Stripe, Inc.), or Apple Services (Apple Inc.), among others.

III. Collection of user data

We need to collect personal data to provide our platform and related services. The correct functioning of the Coovy platform depends on the collection and authenticity of the personal information. The data listed below is collected by us or on our behalf, using third-party services. The provision of incorrect or even harmful data by a user is prohibited and will be reported to the authorities. We therefore ask you to never transmit incorrect or harmful data via our platform. There are various ways in which we collect your personal data. These include:

A. Collection of data that is personally transmitted by users

B. Collection of data from and about users that arise while using the Coovy platform

C. Collection of data about users that can be obtained from other sources (“third parties”)

A. Collection of data that is personally transmitted by users

  • Registration of an account as an influencer:
    When registering for such an account, we first collect information necessary for your registration, such as email address and password. You must then create a personal profile so that you and the other users can use the functions of our platform correctly. The creation of your profile includes the addition of a profile photo, your name, your gender, as well as details of the industries (“categories”) in which you would like to work as an influencer. You also have the option of adding links to your social media profiles with third parties. We collect data about your profiles from the respective external social media networks, if this is possible. In particular, we collect data about the number of your followers and their demographic characteristics (your “audience”), published posts, contributions and their response (“interaction” of your audience), as well as your frequency of use in these social media networks. We may need additional information from you at some point in the future after you have already created an influencer account, including information to confirm your details (e.g. a copy of your personal identification (ID card)).

  • Registration of an account as a business:
    When registering for such an account, we first collect information necessary for your registration, such as email address and password. You then have to create a company profile so that you and the other users can use the functions of our platform correctly. To create your profile, you need to add a profile photo / logo, company name, address, name of a contact person and telephone number. We may need additional information from you at some point in the future after you have already created a business account, including information to confirm your information (e.g. proof of your company’s registration).

  • Uploading content for the creation and execution of campaigns (business):
    When you create a campaign as a company, we collect the information that you provide in your campaign details, including title and description texts, name of the product being marketed, operational time / term (dates), address, company name, number of influencers sought, desired number of influencers’ followers, desired gender of the Influencer(s), campaign type and its target channel (selection of various known social media platforms, as well as the type and scope of the desired contribution by the influencer (“post types”)), industries or “categories” to which the campaign belongs, and campaign budget (e.g. payment or service for the influencer, after completion of the campaign). After the campaign has been carried out, we may ask you for an evaluation for the influencer, which we will make available to the users of our platform. Depending on the type of campaign you want to create, we may ask for additional approval information or licenses to submit. If you want to run a campaign with an influencer of our platform, you have to provide your payment information beforehand, such as adding a credit card or a bank account. We use an external payment provider (Stripe, Inc.) to process payments. Your data will be collected, processed and stored in cooperation with this service provider and using technological security measures. We collect the payment information you provide, including your bank code and tax information, if necessary.

  • Uploading content for the execution of campaigns (influencers):
    If you participate in a marketing campaign as an influencer, or want to work with a business through our platform, you have to upload content (in particular photos, or URLs to external content provided in cloud services, or on social media profiles, as evidence of the creation of content for the campaign). This information is stored by us and made available to the users who take part in the campaign (in particular the business that created the campaign (“client”). After carrying out a campaign, you can submit an evaluation of the cooperation with the business, which we will make available to other users on our platform. In order to receive a payment from the client for the services you provide, we need your payment information, in particular credit card or bank account details. We use an external payment provider (Stripe, Inc.) to process payments. Your data will be collected, processed and stored in cooperation with this service provider and using technological security measures. We collect the payment information you provide, including your bank code and tax information, if necessary.

  • Upload content when communicating with other users:
    You can exchange information with other users via a messaging system. These include in particular text messages, information about your location, pictures, videos and documents. If you transmit such data via the messaging system, we will collect and store it together with the date and time and transmit it to the respective user (“conversation partner”). This is done for the purpose of the functionality of our platform and to improve the user experience. We use the services of suitable third parties (in particular SendBird, Inc.) for the collection, processing and storage of message content. We have no influence on the content of this data shared by users. Please always handle the transmission of information to other users carefully and in particular do not transmit any sensitive data about yourself or other people. The shared information may only be used for the purpose of efficiently carrying out campaigns via the platform. You must never transmit incorrect, unauthorized or harmful data to us or other users. You have the option to report other users via the messaging system, or even block them. Use these functions if you have the impression that another user is using the messaging service incorrectly. If you have a bad experience using our messaging system, please contact us immediately.

  • Uploading content when communicating with us:
    When you contact us or we contact you, we collect all of the information you provide, including the content of messages or attachments that you transmit to us.

B. Collection of data from and about users that arise while using the Coovy platform

In order to make the services we have developed accessible to the users of the Coovy platform and to ensure the best possible user experience for all users, it is necessary for us to collect data from the users while using the platform. These include in particular:

  • Location information:
    In order to be able to create a campaign (business) or to work on a campaign (influencer), it may be necessary to specify a location or to determine your current location via an automatic GPS tracking. The Coov platform collects, processes and stores location information from users (including GPS and WiFi data) on a large scale in order to guarantee the functionality of the services of our platform for all users. Depending on your settings in the user account of the platform and device authorizations, the scope of the collection of location data can vary. If you use the platform as a company, we primarily collect the business address you provided and may compare it with your exact location when you open and use the Coovy app. Similarly, once you create a campaign, it can be matched to your location. In most cases, location tracking is not necessary for business accounts. If you use an influencer account, we record the exact location of your device as soon as you open and use the app, even if the app is only running in the background on your mobile phone. We will also save your exact location for a limited time after you have left the app to enable you to receive messages and notifications, especially from business clients and about campaigns that exist around your last saved location. This makes it easier for potential clients to find and contact you at your last saved location, even if you are not currently on the Coovy platform.

  • Device information:
    We collect data about the devices you use to access the Coovy platform, including device model, device IP address, operating systems and versions, mobile network (e.g. 4G / LTE), device settings and language settings, application installations and software, device identifiers, advertising identifiers, and push notification tokens, if possible.

  • Data on usage:
    In order to ensure the functionality of our platform and to improve the user experience for all users, we collect information about how you use the Coovy platform. This includes in particular information about individual sessions (e.g. date, time, location, activities, viewed content), as well as information about ratings, messages and payments you have made or received. We also collect, process and store information about crashes of our platform services during use, as well as pages or services of third parties with whom you interacted before using our services.

  • Cookies, analytics and third party technologies:
    We collect information using cookies, tracking pixels, data analysis tools, SDK, and other third party technologies to understand how you navigate the Coovy platform and interact with content and advertising. Cookies are small text files that web servers and apps place on your device. They are used to store basic information and to help websites and apps to recognize your browser, PC or mobile device. By using cookies, we can provide users of our platform with more secure and user-friendly services that would not be possible without the use of cookies. Cookies help us to authenticate the users of our platform, to recognize user preferences and settings, to determine the popularity of content on our platform, to better understand the online behavior and interests of our users and to analyze the effectiveness of content and advertising campaigns on our platform. We can use both session cookies and persistent cookies. A session cookie disappears after you close your browser or app. A permanent cookie is retained after you close your browser or the app and can be called up every time you use the Coovy platform. In order to change your cookie settings or to delete cookies that have already been set, you must check the settings of your browser, mobile phone or PC. Please note that you may no longer be able to use certain functions of the Coovy platform if you delete or do not accept cookies from us.

C. Collection of data about users that can be obtained from other sources (“third parties”)

Through the services of third-party providers, we can obtain information that is important for the security, functionality and further development of the Coovy platform, as well as for offering more products to our users. These services include, in particular, user authenticity checks, loyalty programs, promotions, insurance services, financial services and others. If possible, we receive the following information about you from the providers of such services:

  • Security information about users, such as identity checks, credit check and fraud detection;
  • Information about user participation in advertising campaigns, or loyalty programs, user demographics and information on market segments;
  • Information from social media networks whose apps or websites the users use and which use our API or whose API we use;
  • Information submitted as part of the Friends-Recommend program. If you are referred to us by someone, we will collect information about you from this recommendation, including your name and contact information. You can have this data deleted at any time. If you notice an unauthorized transfer of your data to us, we ask you to inform us immediately;
  • Information about users from publicly available sources, as far as this is legally permitted and appropriate;
  • Information from law enforcement agencies;
  • Information about the user due to the cooperation with agencies, especially if the user is represented by an agency and the user has authorized the agency to exchange information with us about the user. We store the information about users that is transmitted by agencies. If you notice that an unauthorized administration of your personal information is taking place, you must report this to us immediately. We are not responsible for checking authorization of agencies. In individual cases, we can request proof of the authorization from the agency.

IV. Processing and use of user data

For the functionality of the services provided by us via the Coovy platform, it is necessary that we process and use the collected user data. This is done in part using suitable external service providers who receive the processing order from us (in particular Google Inc., Google LLC, Alphabet Inc., Apple Inc., Stripe, Inc. and others). We always do this in accordance with the applicable laws and using technological security systems for the processing of data. We always strive to protect your data from access by unauthorized third parties. Below we explain to you the purposes for which we process and use your personal data:

A. Provision and improvement of functions and services within the Coovy platform

To be able to provide and improve the services of our platform, we will use your personal data for the following purposes:

  • Carrying out analyzes and tests on the use of the app to be able to develop new functions, services, products or partnerships for our users;
  • Evaluation of your personal app settings and hardware and software errors on your device to prevent future crashes;
  • Analyzes and Follow-ups of created campaigns and their implementation with users of our platform, inside and outside of our platform (in particular the response to published content in external social media networks of the users);
  • Calculation and processing of payments in the context of campaign budgets, fees, commissions, and payments (applies to both business users and influencers);
  • Communication between the users of our platform, in particular between businesses and influencers, in order to share information about the collaboration on marketing campaigns;
  • Visualization of progress and results of campaigns and other marketing activities of the users inside and outside the Coovy platform;
  • Implementation of services from suitable external service providers (“third parties”), the use of which is necessary for the functionality of the Coovy platform and in particular to facilitate the user experience on our platform;
  • Marketing-related and non-marketing-related communication in the context of research and development, for the promotion of new functions and services, as well as advertising, contests, and other promotions or marketing programs of the Coovy platform and its partner companies.

B. Ensuring and improving security for users of the Coovy platform

At Coovy, we work hard to ensure your safety while using our platform. For this it is necessary that we use the personal data of our users. This applies above all to the following use:

  • Verification of user identities to ensure that they exist and have legal authority to use our platform;
  • Authentication of users when using the platform services;
  • Assistance and advice on problems between users of our platform;
  • Monitoring our (online & offline) processes, including security practices, algorithms and other systems of our platform;
  • Detection of fraud and malicious use of our platform and support for law enforcement agencies;
  • Detecting and excluding users who engage in fraudulent activity on the platform;
  • Establishment of secure and promising collaboration between users of our app, secure communication and information exchange.

C. Establishing and promoting information exchange between users of the Coovy platform

In order to guarantee the efficient functionality in the cooperation of our users, we will use your data for the following purposes:

  • Business profile:
    Presentation and display of your company profile to other users on the platform (including the non-sensitive information that describes your company: profile photo / logo, company name, address, name of a contact person and telephone number. If you use the services offered by the Coovy platform and run marketing campaigns, influencers may give ratings on the collaboration with you after a campaign, and these influencer ratings of your activities on the platform will be shared with other users so they can get an idea of your work quality. We may display additional information in your profile at some point in the future. Sensitive data, such as your payment details or passwords, are of course excluded from disclosure, unless you voluntarily and independently share this information with another user, for which we assume no liability.

  • Influencer profile:
    Presentation and disclosure of your influencer profile for other users on the platform (including the non-sensitive information that describes you as a person: profile photo, name, gender, as well as details about the industries (“categories”) in which you work as an influencer. There is also the possibility that we make the links to your social media profiles available to users or third parties, as well as share information about how many followers you have with these external social media networks, or information about the activities and interaction of your audience with your respective social media profile. If you use the services of the Coovy platform and engage in campaigns, business users may evaluate the cooperation with you after a campaign. These evaluations of the businesses regarding your activities on the platform will be made available to other users so that they can to get an idea of your work quality. We may display additional non-sensitive information about you to the users on the platform at some point in the future. Sensitive data, such as your payment details or passwords, are of course excluded from disclosure, unless you voluntarily and independently share this information with another user, for which we assume no liability.

  • Messaging system:
    When information is exchanged between users through the messaging system, the relevant data (in particular text messages, location sharing, videos, images and documents) are transmitted to the conversation partner (“user”), if you press the “Send” button in the conversation window after entering your message, or by using the respective function for sending pictures, videos, documents, or location information.

  • Creation and implementation of campaigns:
    As outlined in Section III. A., we collect personal information when creating a campaign as a business user and when carrying out a campaign as an influencer. When you create a campaign, we share the information you provide about your company and your desired campaign with the users on our platform. This relates in particular to your company name, your profile photo / logo, the title of the campaign, the product name, the campaign description, ratings about you, the location or address, information about the budget or payment, planned start and end dates of the campaign, and terms and conditions for the shared content on the influencer’s social media profiles. When you apply for a campaign as an influencer, we share your personal profile information with the business, such as your name, profile photo, your gender, ratings about you, links to your external social media accounts and number of followers, last saved location (e.g. city name) and your preferred industries (“Categories”). When executing a campaign, you, as an influencer, usually have to submit the content created for the campaign to the business (“client”), e.g. photos and videos, texts, as well as URLs to the published content on external social media platforms. If you use this function within our platform, we will transmit the information provided to the respective business. If you transmit this data for the execution of the campaign outside of our platform, this is beyond our area of responsibility.

  • The data defined above are stored and processed by us and our external service providers for the maintenance of the platform (Google Inc., Google LLC, Alphabet Inc., Apple Inc., SendBird, Inc., among others) and can also be processed and evaluated for the purpose of product improvements.

D. Offering help and support services to users of the Coovy platform

In order to be able to offer all users of the Coovy platform a very good experience in using our services, we will use your personal data to help you and other users to solve problems that arise from the use of the platform. Based on the experience of our users, we will analyze and evaluate usage data of our platform, which can serve all users in the future in the event of problems and support troubleshooting. In particular, we store and process inquiries and related information transmitted and share them internally with our employees so that the problems of users can always be processed efficiently. By analyzing user requests and their solutions, we can improve our customer support processes. With your permission or on your further instruction, we can also disclose your personal data to third parties in order to fulfill the purposes you have requested.

E. Fraud detection, criminal prosecution and assistance to local authorities in law enforcement and litigation, as well as other legal obligations

It may happen that we use the personal data we collect to report fraud or to make payment claims. We also use this data in individual cases to check claims or disputes relating to our services or official claims. At the request of supervisory authorities, or government agencies, we share personal data with these authorities, insofar as we are obliged to do so and as permitted by applicable law.

V. Storage and security of user data

If you have a user account on our platform, we store your personal data for as long as is necessary to be able to offer our services to the users of our platform. As long as you have a user account, we will store the data you have generated in accordance with this data protection declaration and, moreover, in accordance with our legal obligations. In particular, this applies to data in connection with your identity, your payment transactions, as well as in cases of fraud. If you no longer want to use our platform, you can request the deletion of your account and your data at any time. For this, please note the information in section V. B. below.

A. Data security

We always take current and appropriate measures to protect your personal data. We pay particular attention to encryption technologies and the latest data transmission standards, so that we not only guarantee a minimum of data security, but always want to achieve even higher security levels. In principle, however, it applies in online data transmission and storage that no security measures can be 100% effective. Therefore, we cannot guarantee the security of your data completely, not even against unauthorized access or acts by third parties.

B. Your rights and options regarding your data

  • You can ask us at any time about which data we collect from you. We also enable you to make changes or updates to your data, through the settings in your user account on our platform, or in direct contact with us.
  • You can make changes to the way we collect personal data and which data is collected, through the individual data protection settings in your user account on our platform.
  • If you use our platform, your device will try to get your current location. You can prevent or deactivate this function by rejecting the request or deactivating the location function in your device settings. If you do this, it will significantly impair the functionality of the Coovy platform for you and prevent the provision of our services for you.
  • Your device or your browser may offer the “do-not-track” function. Using this function you inform the providers of online services, in particular websites and apps, that you refuse to have your activities on the Internet tracked. At the moment, the Coovy platform does not support any “do-not-track” requirements, so we cannot offer this function to you.
  • As outlined in section III. B., we use cookies and tracking services. You can always define your cookie preferences yourself in your browser or your device. If you delete our cookies or reject the use of cookies, we cannot guarantee that you can use our platform correctly, as some important functions may then be missing.
  • You can view and update your profile information at any time by selecting the menu item in your user account to change your profile information.
  • You can unsubscribe from our commercial emails at any time by clicking on “unsubscribe” in the respective email. This excludes security emails, as well as emails about transactions and functions in connection with your use of the Coovy platform.
  • You can disable receiving push notifications via your device settings. Please note that deactivating push notifications can affect your use of the Coovy platform (e.g. information on pending applications or payments).
  • You can have your Coovy account deleted at any time. For this you can contact us at any time by sending us an email or by using a contact form on our website, stating your user account which should be deleted. If your account is suspected of malicious activity, such as fraud, security breaches, or violations of other applicable laws, we cannot delete some information from your account. Furthermore, it may be necessary for us to keep some of your data in order to comply with legal or official obligations, or whenever this is appropriate. In this case, we keep your data in a way that prevents the other use of your data.
  • Wherever we are required by law and whenever necessary, you can request information about what specific information we have collected about you, the categories about your user data that we have collected and created about you, the categories from the sources from which we have collected and created your data, business and commercial purposes for collecting your data, as well as the category of third parties who have gained access to your data. You can request at any time to have these collected personal data deleted by us and our service providers, to the extent and within the scope of our legal obligation. For this you can contact us at any time by sending us an email or by using a contact form on our website, specifying your user account.
  • We strive to respond within 30 days of receiving a request for data information or deleting a user account. If we need more time, we will inform you about, stating the reasons for the delay and the expected processing date.

C. Minors and children data

You must be of legal age to create a user account and use the services of our platform. The Coovy platform is not aimed at minors or children under the age of 13, so we do not want to collect any personal data about these people. Children under the age of 13 in particular are strictly prohibited from using our platform. If a minor or a child under the age of 13 makes use of our platform, we will delete this data immediately after the misuse has been determined. If you notice the use of our platform by a minor or a child under the age of 13, please contact us immediately.

D. Links to third party websites or services

In some cases, our platform contains links to third-party websites or services. These external service providers may have different data protection guidelines for their websites and apps, which is why you should read the applicable guidelines and data privacy policy before using them. We are not responsible for these websites or services. Our area of responsibility ends when you leave our platform to a third party. If you have any questions about a particular privacy policy and data protection, please always contact the responsible operator.

E. Changes to this privacy policy

We may update our privacy policy (data protection declaration) from time to time if necessary. If you use our platform, the current version of our privacy policy always applies. Your consent to the respective updated privacy policy results from your subsequent use of our platform. Our privacy policy is updated online. If significant changes take place, we will inform you via our platform services or by email. You are free at any time to stop using our services after we change our privacy policy.
